A Grade A Customary Court in Ibadan has dissolved a marriage of 30 years between one Abosede Fasoyin and her estranged husband, Isola Fasoyin, on grounds of desertion and irresponsibility.
Delivering judgment, President of the court Mrs S.M. Akintayo, held that the marriage was dissolved because the petitioner was unwilling to continue to wait endlessly for Fasoyin.
“Therefore, the 30-year-old union between Abosede and Fasoyin is hereby, dissolved in the interest of peaceful living.
“Since the three children produced by the union are now grown up, they are each free to stay with whoever pleases them,” Akintayo said.
Earlier, Abosede had told the court that she filed the divorce suit because Fasoyin had for the past five years abandoned her, leaving her to wallow in penury and hunger.
“My lord, not only did Fasoyin desert home, he also refused to take any form of responsibility on the children and I.
“Despite the fact that I reported the incident to his parents, particularly his father, nothing was done to bring him back home.
“In fact, we don’t know his whereabouts and that is the reason why the bailiff served him by substituted means (pasting it on his family’s house door).,” Abosede explained.
According to her, the respondent performed all the necessary marital rites on her on Oct. 3, 1996, following the payment of the required N5000 bride price and presentation of gifts.
She added that Fasoyin’s disposition gradually worsened with time and for over five years now, kept away from his matrimonial home without any tangible reason for it.
Meanwhile, the respondent was not in court when he was called to begin his defence.
From the records of the court, the bailiff served several substituted hearing notices on Fasoyin, but he still refused to enter an appearance. (NAN)
